Many of us have had the experience of seeking out a second opinion on a medical issue only to find out that the two doctors we consult do not agree with each other. When a misdiagnosis could literally mean the difference between life and death this can present a serious problem for the patient.
When the patient is made aware of each doctor’s conclusions and the rationale behind those conclusions then at least the patient can make an informed decision based on his or her level of risk tolerance. It becomes more complicated, however, when the one doctor who is on the right track ends up not communicating his or her suspicions and the other doctors are missing the signs and not ordering the right tests.
One such situation arose in the following case:
Several doctors had an opportunity to diagnose their male patient’s prostate cancer while it was in its early stages. The patient first saw his primary care physician, a general practitioner, with urinary problems when he was 56 years old. The general practitioner concluded that the problems were not related to cancer although no testing was done to rule out cancer. Ten months later the patient consulted with a urologist who performed a digital examination on the prostate gland and ordered a PSA blood test. As it turned out this urologist was not an approved provider under the patient’s insurance and so the patient consulted with a second urologist.
Although the blood test results came in neither the results of the test nor the first urologist’s suspicion of cancer and recommendation that a biopsy be conducted were communicated to the patient’s primary care physician or to his second urologist. The second urologist concluded that the examination of the prostate was normal and that there was no evidence of cancer. As such the cancer went undiagnosed for two years at which time it had spread beyond the prostate. The physicians treating the patient’s cancer concluded that he likely had only one to five years to life as a result of the cancer’s spread. The law firm that handled this matter reported that they were able to achieve a settlement during jury selection at trial in the amount of $2.5 million on behalf of the patient.
In this case example it is interesting to note that both the general practitioner and the second urologist missed an opportunity to order PSA testing. This is a simple blood test that measures the amount of protein-specific antigen in the blood stream. This antigen is produced in men by the prostate gland. An elevated level of the antigen in the bloodstream can be caused by cancer of the prostate.
Because the level of antigen can be elevated for reasons other than prostate cancer an abnormally high test result is generally followed by diagnostic testing to determine whether the patient has prostate cancer that is causing the abnormal PSA levels. So while it would not have been conclusive by not ordering a PSA test the general practitioner and the second urologist failed to obtain a crucial piece of information that might have led them to the correct diagnosis.
The general practitioner also failed to perform a digital examination to determine whether there was any palpable abnormality to the prostate gland. The second urologist conducted a digital examination but failed to pick up any abnormality of the gland. The second urologist thus relied on only one test - a test that is unreliable for two main reasons. First, the digital examination only allows access to part of the prostate. If there is an abnormality to the part of the gland that cannot be reached during the examination the abnormality will not be found. Second, the digital examination is only as good as the sensitivity of the physician conducting it to detect an abnormality.
This case thus illustrates two main types of failures. There was the failure on the part of the general practitioner and the second urologist not following the proper screening guidelines. And there was the failure of communication among the different physicians. Although it impossible to know whether the general practitioner or the second urologist would have followed up on results of the PSA test from the first urologist or on that urologist’s suspicion and recommendation they at least would have had information and perspective they were missing.
When physicians succumb to these types of failures and they in turn lead to a delayed diagnosis of a patient’s cancer so that a cure is no longer possible then, as in the case above, the physicians may be liable for medical malpractice.

Although there has recently been a certain amount of debate over what the standard of care should be in screening asymptomatic male patients for prostate cancer one factor remains constant: if the result of a screening test is abnormal the patient needs to be informed of the results and advised about the option for diagnostic testing such as a biopsy.
Should the doctor fail to do so the patient’s prostate cancer may spread and metastasize thereby become incurable before the patient becomes symptomatic and is finally diagnosed. That patient and his family may have a failure to diagnose medical malpractice claim against the doctor.
The digital examination of the prostate gland is one of the two tests routinely used to screen men for prostate cancer. The presence of a nodule or hardened area on the gland is an abnormal finding that could indicate cancer. Below are three examples of cases involving abnormal findings on a digital examination:
Case 1:
This case involved a 73 year old male patient whose PCP (primary care physician). Even though the patient did not have any symptoms of prostate cancer the PCP correctly performed the appropriate screening tests. The PPCP ordered PSA blood testing and performed a digital examination. The blood tests showed abnormally high levels of PSA. The digital examination revealed that the patient’s prostate was enlarged. Two signs pointed toward the possibility that the patient had prostate cancer.
Yet, the PCP did not inform his patient that the results of the blood test and the digital examination were abnormal and suspicious for cancer. The PCP likewise did not order any follow-up tests to rule out prostate cancer. By the time the patient was finally diagnosed the cancer had metastasized to the bone. The law firm that handled this case reported that they were able to achieve a recovery of $591,000 on behalf of the patient.
Case 2:
This case involved an internist who was seen by a patient complaining of urinary problems. The internist performed a digital examination and noted that the patient’s prostate gland was enlarged. The internist then ordered a biopsy. This is standard when there is an abnormal finding on the digital examination. The biopsy was performed at a local hospital. The pathologist who examined the biopsy samples documented in a written report that the samples contained prostate cancer. It took a year before the results were not communicated to the patient. The delay allowed the cancer to spread. It eventually took the patient’s life. The law firm that handled this case reported that the matter settled prior to trial for a confidential amount.
As both of these cases demonstrate it is not enough to comply with screening guidelines. Doctors must follow up when the results of screening tests come back as abnormal. Not doing so puts the patient at risk that he does in fact have prostate cancer and that the cancer will grow and spread to the point where it metastasizes and is no longer curable. If that happens the best that treatment can do is to slow down the spread of the cancer and eventually to minimize the effects (such as pain) of the cancer. All likely fully preventable if the doctor follows up on the abnormal screening test results.
Thus a doctor who does not follow up when, for example, a digital examination catches the presence of a nodule or hardened area on a patient’s prostate gland may be liable for medical malpractice.

Delayed diagnosis of prostate cancer cases are all too common. One common type of medical error that forms the basis for these cases occurs when the male patient’s family doctor (1) actually screens the patient for prostate cancer by monitoring the level of PSA (Prostate Specific Antigen) in his bloodstream, (2) notes abnormally elevated levels of PSA and yet (3) neither informs him of abnormal results nor orders diagnostic tests, such as a biopsy, to rule out prostate cancer. The three cases below illustrate this situation.
Case 1:
In this case a male patient followed up when advised by his internist that he probably had cancer. The diagnosis: advanced prostate cancer. The issue in this case was that the internist did not inform the patient that he might have cancer until the third year of elevated PSA test results. The year before the patient’s PSA level had risen to 13.6. Two years prior to that it had been at 8.0. During these years the internist took no action to rule out prostate cancer as the source of these elevated readings and did not inform the patient. By the time he was diagnosed surgery was not among the treatment options. Instead the patient underwent radiation therapy and hormone therapy in an attempt to slow down the further progression of the cancer. The law firm handling this matter reported that the case went to mediation and settled for $600,000.
Case 2:
In this case a male patient found out when he was 64 years old that he had prostate cancer that had spread to the seminal vesicles. He only discovered that he had cancer because a family member urged him to consult with a urologist. It was the urologist who diagnosed the cancer. The patient’s family doctor, a general practitioner, had been screening the patient for prostate cancer through PSA testing. Yet, he never told the patient that his PSA level had been elevated and rising - from 5.95 and 5.33 to 7.04 over a period of sixteen months. Not only did this general practitioner not tell the patient that this readings were abnormal and might be due to prostate cancer, he actually told the patient that the results were normal for a man his age. The law firm that handled this matter reported a settlement in the amount of $1,500.00.
Case 3:
In this case, a male patient was diagnosed with advanced prostate cancer at age fifty after switching doctors. His prior doctor, a family doctor, had ordered a PSA test to screen for prostate cancer when the patient had gone in for his annual physical five years earlier. Even though the test results came back abnormally high the doctor never repeated the test and never ordered a biopsy to rule out prostate cancer. By the time he was diagnosed his only options for treatment was to attempt to slow the progress of the cancer. A cure was no longer possible. The law firm that handled this matter reported that the case settled for $750,000. This settlement amount represents the maximum value of the claim for him and his wife ($250,000 each due to caps of non-economic injury) and his estimated lost earnings.
As the above cases illustrate doctors sometimes follow the guidelines in performing screening for prostate cancer yet when the test results are abnormal they do not follow through. At a minimum they should inform the patient that the results of the screening tests are abnormal and refer the patient to a urologist. Another option is to order suggest diagnostic testing, such as a biopsy. When they do nothing in the presence of abnormal test results and the patient later learns that he had prostate cancer and that the delay resulted in it spreading outside the prostate thus limiting treatment options and decreasing his chances of surviving the cancer, the patient may have a claim for medical malpractice.

At the present time there is no cure for prostate cancer. In other words no one treatment or combination of treatment has been found to be 100% effective in curing a malignant tumor of the prostate. But, nearly all men with the prostate disease can take hope. The primary reason for this hope is that many of these treatments and combination of treatments have been found to slow or stop the growth of the cancer for more than 5 years or longer.

Many of these same men will go on to live for more than 10 years or longer. If an individual has reoccurring or advanced prostate cancer they may choose to have the entire prostate gland removed. This surgical procedure is called a radical prostatectomy. Along with the removal of the prostate gland surgeons will usually remove the lymph nodes surrounding the prostate as well.
If the prostate cancer has not spread beyond the prostate gland Cyrosurgery may be used to kill the cancer cells. Cyrosurgery uses extremely cold temperatures to freeze and effectively destroy the cancer cells.
In an effort to reduce testosterone levels in the body permanently doctors may suggest removing the testicles. This procedure is called an orchiectomy. Patients who receive this surgery may choose get prosthetics inserted that have the same shape and size of the testicles.
Cutting Edge Treatment for Prostate Cancer:
One of the exciting new treatments for advanced prostate cancer that is currently being developed involves using genetically modified viruses and Prostate-Specific Antigen .

Over the years, various news reports have associated many different lifestyle factors with an increased risk of developing breast cancer. The most common have been: obesity, low levels of physical activity, using hormone therapy, eating meat, not eating enough fresh vegetables and fruit, alcohol consumption, smoking, not having children or having children ‘later’ in life, and not breast feeding.
Time and time again, we see reports and studies that point the finger of blame to just one factor. These short-sighted theories continue to fall flat on their faces. Of course it’s not just one thing. Of course it’s not just one cause. That’s unscientific thinking.
For every woman who, for example, has a low level of physical activity and also happens to develop breast cancer, there are many more who share the same sedentary lifestyle and will never develop the illness. Yet, we know of many extremely active women who have developed breast cancer. It’s not one thing.
It’s the same as the fit, trim, veggie-eating-picture-of health-person who suddenly experiences major health issues. Meanwhile that same person has relatives of a ripe old age who have never exercised a day in their lives, eat bacon and eggs and fast food all the time, can’t remember the name of a vegetable, let alone the last time they ate one, and lay on the couch all day watching television, drinking beer and smoking cigarettes! There they are - “healthy” at 90 years of age!
How do we explain this? It’s certainly not genetics. How could it be? Think of all the examples in your own family where that makes no sense. There’s always somebody who was “the first” to develop a so-called genetic disease. And there are always family members who will never develop certain chronic illnesses that their relatives have. It doesn’t add up.
In my family, my mom was the first and only to ever be diagnosed with breast cancer. She has 5 sisters and dozens and dozens of aunts and nieces. Her sisters are all in their late 70’s and 80’s now, and several aunts are in their 90’s. No breast cancer. She was the only one. Where’s the genetic connection?
The challenge is that it’s not that easy. It’s not that clear.
Our current level of health is 100% the result of the choices we have made up to this point in our lives, as well as the external environment we’ve been exposed to throughout the years.

In the summer most people find themselves outdoors relishing the warm, sunny days by sun tanning. The beaches, swimming pools, parks, campsites, and sporting events are often packed with sun lovers. The warmth of the sun on a beautiful, sunny day will entice many of us to soak up the rays instead of staying indoors. However, it is important to protect your skin while sun bathing.
The sun’s ultraviolet rays can cause irreversible damage to your skin if not protected, so taking a few extra steps to avoid a sunburn is mandatory. Below are a few guidelines to avoid destruction of your skin while you are trying to achieve a tan.
1. Use a sunscreen with a high sun protection factor (SPF). The higher the number the better - especially for
fair complexions. It may take longer for you to achieve a tan, but it is always best to obtain a gradual glow to
your skin. A high SPF will prevent a painful sunburn, so apply the lotion on every exposed part of your body. If
you are swimming, you will need to purchase a waterproof sunscreen to avoid reapplication. Even normal
perspiration can remove sunscreen, so a good rule of thumb is to buy waterproof lotion. It is imperative to use
sunscreen on children. Most skin damage and cancers can result from the early years of non-protection.
2. For those who prefer using a tanning bed or a heat lamp to achieve that ‘healthy’ glow, use a sunscreen as
well. Most importantly, cover your eyelids with moistened cotton balls. The eyes are ultra sensitive to heat
and light. It should not affect your ‘tan line’ if you use the minimum amount of time in the tanning bed. Never
stay in longer than the required time. As mentioned above, a gradual tan is always better.
3. Normal activity outdoors such as gardening, biking, or walking involves motion, so you aren’t actually getting
direct, straight-on sun exposure. Wear a cap and sunglasses to protect your eyes. Apply sunscreen on the
face, top of ears, neck, arms, etc. When gardening, you will notice many people wear a straw hat with a wide
brim. This is wonderful protection against sunburn. A lightweight straw hat allows aeration that will lessen
perspiration versus a solid hat.
Whatever activity draws you out in the summer sun, whether it is work or play, just remember to take a few extra precautions before heading out. It’s a win-win situation all the way around.
